In a negligence lawsuit filed on Wednesday in state court in Orlando, a customer named Paul Kerouac is seeking more than $100,000 in damages from Dunkin’. Kerouac alleges that he sustained “severe and long-term injuries” due to an exploding toilet at one of the coffee chain’s central Florida locations in Winter Park a year ago.

Following the toilet explosion in the men’s room, which left Kerouac covered in human waste, urine, and debris, he exited seeking assistance from employees and the store manager, as outlined in the lawsuit. According to the legal filing, an employee informed him that they were aware of a “problem with the toilet” due to previous incidents, although the lawsuit did not provide additional details about the explosion itself. Kerouac claims to have suffered “bodily injury” and has required mental health care and counseling since the incident occurred in January 2022.

The lawsuit alleges Kerouac suffered “bodily injury and psychological damages resulting in pain and suffering, disability, permanent and significant emotional injury, mental anguish, loss of the capacity for the enjoyment of life, expense of medical care and treatment.”
